§ 13 Cancellation Policy/ Right of Return

A declaration of agreement can be revoked in a written way (E-Mail, letter, fax) within 14 days without specification of reasons.

The period of returning goods begins after receiving the instructions for the right of withdrawal in text form but not before receiving the goods and not before the compliance of our duty of information according to section 246 § 2 in association with § 1 indention 1 and 2 EGBGB.

In order to maintain the cancellation period the seasonable dispatch of the cancellation or the good will suffice.

Cancellation consequences:

In the case of a successful cancellation, services received by both sides and benefits if applicable (e.g. interests) have to be given back. If the customer is only able to give back the service received partially or in a deteriorated condition, the customer is obligated to compensate. In the case of goods surrendered this does not apply if the deterioration of the goods is brought about solely by a tryout thereof - such as would have been possible for the customer, e.g. in a retail shop. As for the rest, the customer can avoid the duty for compensation for a deterioration of the good caused by a use in accordance with regulations by not treating the good as its own property and omitting everything that will affect its value. Goods capable of being shipped as a parcel will be shipped at SWOX Surf Protection´s risk. Goods not capable of being shipped as a parcel will be collected at the customer´s place. Obligations to compensate payments must be complied within the period of 30 days. For the customer the period begins with the customer´s declaration of revocation or with sending the good. For SWOX Surf Protection the period begins with receiving the declaration of revocation or with receiving the good.

The right of revocation is not valid for distancesellingcontracts

  • for the delivery of goods which are customized or which are obviously custom-built or which are due to their state not suited for a return or which are easy to contaminate or whose expiration date was expired

  • for the delivery of audio and video recordings or of software, provided the delivered data medium was unsealed by the customer

  • for the delivery of newspapers, magazines and journals
